1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you and A2Z Comfort Solutions ("we," "our," or "us"). By accessing or using our website, scheduling services, or otherwise engaging with our business, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services

A2Z Comfort Solutions provides heating, ventilation, air conditioning (HVAC), and related services for residential and commercial properties. Our services include but are not limited to installation, maintenance, repair, and consultation.

We reserve the right to refuse service to anyone for any reason at any time.

3. Scheduling and Appointments

When scheduling a service appointment, we will provide an estimated time frame for arrival. While we strive to be punctual, circumstances beyond our control may cause delays. We will make reasonable efforts to notify you of any significant changes to the scheduled appointment time.

If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Failure to do so may result in a cancellation fee.

4. Service Estimates

Any estimates provided for services are approximations based on our assessment of the required work. Actual costs may vary due to unforeseen circumstances discovered during the service visit. We will obtain your approval before performing any additional work that exceeds the original estimate by more than 10%.

5. Payment Terms

Payment is due upon completion of services unless otherwise arranged in advance. For installations and larger projects, a deposit may be required before work begins, with the balance due upon completion.

We accept various payment methods, including credit cards, checks, and electronic payments. Late payments may incur additional fees.

6. Warranties and Guarantees

We provide a warranty on our workmanship for a specified period, as detailed in your service agreement. Manufacturer warranties for equipment and parts are separate from our workmanship warranty and are subject to the terms provided by the manufacturer.

To maintain warranty coverage, regular maintenance as recommended by the manufacturer is required. Failure to perform recommended maintenance may void warranty protection.

7. Customer Responsibilities

You are responsible for providing clear access to all work areas, including removing any obstacles that might impede our technicians. You are also responsible for informing us of any pre-existing conditions or issues that might affect our work.

For your safety and the safety of our technicians, only authorized personnel should be present in the immediate work area during service.

8. Limitation of Liability

A2Z Comfort Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with our services, whether based on contract, tort, negligence, strict liability, or otherwise.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless A2Z Comfort Solutions and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any rights of another.

10. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the province of British Columbia, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the courts located in Vancouver, British Columbia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
